1. General Provisions These Terms govern the use of the PromoPoint mobile application, website and related services designed for couriers, field staff, dispatchers and companies that create, assign and supervise work tasks. PromoPoint is used to register a mobile account, connect a user to a company, receive and perform tasks, display routes, record work stages, deliver service notifications and provide other functions expressly available in the interface. By starting registration or continuing to use the service, the user confirms that they have read, understood and accepted these Terms in full. 2. Registration and Account The mobile account is created by the user through self-registration. The user must provide accurate and up-to-date information and keep their login credentials, password, one-time codes and other access tools confidential. A company, dispatcher or another authorized representative may connect the user to an organization, provide access to tasks and workflows or send an invitation only after the user has independently registered and consented to such connection and participation in the relevant work environment. If the user does not confirm joining a company or withdraws such consent through the available service mechanisms, the organization will not receive, or will only retain limited, access to the user's mobile account through PromoPoint. 3. Task Assignment and Use of the Service Through PromoPoint, the user may receive tasks, review route and visit-point information, update task statuses, transmit service events and use other tools available in the application. The user agrees to use the service only for lawful purposes, not to infringe the rights of third parties, not to attempt unauthorized access to data or features, not to interfere with service operations and not to use the application for covert, unlawful or misleading monitoring. It is prohibited to spoof or falsify location data, task completion times, statuses, routes, credentials or other service events unless expressly permitted by the service functionality. In particular, it is prohibited to use location-spoofing applications or system tools (mock location, GPS emulators), root access, jailbroken devices, device-identifier-masking utilities, or VPN/proxy services where such use demonstrably interferes with the operator's ability to verify the work process. 4. Background Location Assigning a task does not by itself automatically start background location transmission. Background geolocation may be transmitted only when all of the following conditions are met: - the user has independently registered and joined the company; - the user has accepted these Terms, the Privacy Policy and the consent to personal data processing; - the user has granted the operating system permission allowing the application to access location data; - the user has personally switched the assigned task to an active status, such as "In Progress", or enabled a work mode, route or shift that requires this function. During an active task, route or work mode, the application may transmit current coordinates, route points, event timestamps and related technical data in the foreground and background to display route progress, confirm arrival at a location, calculate estimated arrival times, build reports, investigate disputes and maintain operational safety. Background location transmission ends when the task is completed, the active work mode is closed, the location permission is revoked, the user signs out or the relevant function otherwise stops. Separate technical logs and data already transmitted may continue to be stored and processed in accordance with the Privacy Policy and applicable law. 5. Notifications and Service Messages The service may send push notifications, emails and other service communications related to account access, task assignment, status changes, security, app updates, one-time codes and other events relevant to the operation of the service. 6. User Rights and Obligations The user may: - access service features within the scope of the permissions granted to them; - manage device permissions, including location and notification permissions; - contact support regarding access, data processing and application issues; - delete the mobile account using the in-app functionality; once deletion is confirmed, the account is removed from the active service database, tokens, avatar, password-recovery data and operational links are cleared, while an archived record may remain in a dedicated restricted-access table to the extent permitted or required by law; - request updates to their data and exercise other rights available under applicable law and service documents. The user must: - use only their own account; - promptly report any compromised access or unauthorized use of the account; - not disclose their credentials to third parties; - not use the service for unlawful activity; - follow employer or company instructions only to the extent that those instructions do not conflict with the law or the service documents. 7. Company Use of Data The company that the user joins through the service may access information about assigned tasks, task execution statuses, work event logs and geolocation data where such information is generated during an active task or work mode and is necessary for delivery operations, order fulfillment control, logistics, safety and internal reporting. The company must use this data only where it has an appropriate legal basis, strictly for lawful work-process purposes and not for covert monitoring beyond the stated purposes of PromoPoint. 8. Intellectual Property All intellectual property rights in the software, interfaces, databases, design, texts, graphics and other materials that form part of PromoPoint belong to the service owner or are lawfully used by it. The user receives a limited, non-exclusive and revocable right to use the service for its intended purpose only, without any right to copy, decompile, modify, resell, sublicense or create derivative works without prior written permission from the rights holder, except where mandatory law provides otherwise. 9. Limitation of Liability The service is provided on an "as is" and "as available" basis. PromoPoint takes reasonable measures to maintain stable and secure operations, but does not guarantee uninterrupted availability, error-free operation, compatibility with every device and network or the absence of delays in the transmission of location data, notifications or other information. The administration is not liable for consequences arising from: - the user's disabling of location, notifications, Internet connectivity or other permissions required for certain functions; - inaccurate information entered by the user or the company; - actions of third parties, telecom operators, device manufacturers, app stores or integrations that are outside the administration's reasonable control; - unlawful use of the service by the user, the company or other persons. 10. Restriction, Suspension and Termination of Access The administration may restrict, suspend or terminate access to the service in whole or in part in the event of a breach of these Terms, security requirements, applicable law, the rights of third parties or where there is a risk of harm to the service, its infrastructure, users or customer companies. 11. Changes to the Terms The administration may amend these Terms as the service functionality evolves, business processes change or legal requirements are updated. The current version is published within the service and/or on the PromoPoint website. Continued use of the service after a new version is published constitutes acceptance of the updated Terms. 12.
