I hereby freely, voluntarily and in my own interest give my consent to the processing of my personal data when using PromoPoint, including the mobile application, website, personal account, API and other related digital channels. Service operator: Individual Entrepreneur Toderica Ion Alexandrovich.
1. What I Confirm
I confirm that:
- I am independently registering the mobile account;
- I have read the PromoPoint Terms of Service and Privacy Policy;
- I understand the purposes for which my data is processed and agree to such processing to the extent described below;
- I understand that an organization may gain access to my work-related data through the service only after I have registered and confirmed joining that organization or otherwise provided explicit consent through the available functionality.
2. What Data Is Covered by This Consent
This consent applies to the data that I provide directly and to the data generated through my use of the service, including:
- last name, first name and middle name;
- phone number and email address;
- information about my account, invitation, connection to a company, project and access level;
- information about assigned tasks, routes, visit points, statuses, timestamps and other work events;
- coordinates, route points, travel history and other geolocation data generated in connection with an active task, route, shift or work mode;
- device and application information, including device model, operating system, app version, IP address, country derived from IP, push token, authorization tokens, battery level, charging state, signs of location spoofing (mock location, active VPN, root or jailbreak access), error logs and diagnostic events uploaded to the operator's servers;
- avatar and other profile data where uploaded by me;
- support requests and other messages that I send through the service.
3. Specific Consent to Geolocation, Including Background Use
I understand and agree that:
- assigning a task does not automatically start background transmission of my coordinates;
- the application may receive and transmit my location in the foreground and background only after I personally grant the relevant device permission and start an active task, switch it to an "In Progress" status or enable another work mode, route or shift that requires such functionality;
- during an active task, route, shift or work mode, my coordinates, route points, event timestamps and related technical data may be available to the service operator and the company that I have joined for delivery management, confirmation of presence at a location, order-performance control, logistics, safety, reporting and dispute resolution;
- once the active task is completed or the location permission is disabled, background geolocation collection stops, although previously collected data may continue to be stored and processed within the purposes and retention periods described in the service documents and applicable law.
4. Purposes of Processing
My data may be processed for:
- registering and maintaining my account;
- authentication, access recovery and sign-in security;
- connecting me to a company, delivering tasks and organizing the work process;
- displaying routes, tracking active tasks, confirming presence at a location and maintaining work records;
- sending service notifications, one-time codes, update messages and other communications necessary for the operation of the service;
- preventing abuse, investigating incidents, resolving disputes and protecting rights;
- technical support, development and improvement of the service;
- compliance with legal requirements.
5. Permitted Processing Actions
I consent to the collection, recording, organization, storage, updating, retrieval, use, matching, transfer, disclosure, anonymization, blocking, deletion and destruction of data, as well as to other actions required to achieve the stated purposes and permitted by applicable law.
6. Who May Receive or Process the Data
I understand and agree that my data may be processed by:
- the operator of PromoPoint;
- the company that I have voluntarily joined through the service;
- the operator's contractors and technology partners providing hosting, authentication, email and push delivery, monitoring, backup, technical support and other processes necessary for the operation of the service;
- public authorities where required by law.
7. Term of Consent and Withdrawal
This consent is effective from the moment it is granted and remains valid throughout my use of the service and, after that use ends, for the period necessary to achieve the processing purposes, comply with legal obligations, resolve disputes and protect the rights of the parties.
I may withdraw this consent in whole or in part by contacting the service through its contact channels or by changing the relevant device settings where location or notifications are concerned. I understand that withdrawing consent or disabling permissions may make certain application functions unavailable or limited.
I also understand that I may delete my mobile account through the in-app functionality. Once deletion is confirmed, the account is removed from the active part of the service, tokens, avatar, password-recovery data and operational links are deleted, while an archived user record may be retained in a dedicated restricted-access table where and to the extent permitted by law.
Withdrawal of consent does not affect the lawfulness of processing carried out before the operator received the withdrawal and does not prevent processing where such processing is otherwise permitted or required by law without separate consent.
